1. Introduction

This privacy policy (hereinafter "the Policy") is intended to inform users of the website myestatekit.eu (hereinafter "the Site") about how their personal data is collected, processed, used and protected by Eversales Consulting LLC (hereinafter "the Publisher", "we" or "us").

The protection of your personal data is a priority. We undertake to process your data in compliance with the General Data Protection Regulation (EU) 2016/679 (GDPR), the Data Protection Act 2018, the European Communities (Electronic Communications Networks and Services) (Privacy and Electronic Communications) Regulations 2011 (S.I. No. 336/2011), and any applicable data protection legislation.

By accessing the Site, using our services or providing us with your personal data, you acknowledge that you have read this Policy and accept the practices described in it.

For the purposes of this Policy, the following terms have the meaning attributed to them below:

The natural or legal person who determines the purposes and means of the processing of personal data (Article 4(7) GDPR). In this case, this is Eversales Consulting LLC.

2.4 Processor

The natural or legal person who processes personal data on behalf of the data controller (Article 4(8) GDPR).

2.5 Consent

Any freely given, specific, informed and unambiguous indication of the data subject's wishes by which they signify agreement to the processing of personal data relating to them (Article 4(11) GDPR).

2.6 User / data subject

Any natural person who accesses the Site, browses it, uses its features or purchases a digital resource.

  • Operating system

  • Date and time of connection
  • Traffic source (referrer, advertising campaign)

4.3 Interaction data

  • Responses to interactive tools (diagnostic quizzes, simulators)
  • Interactions with emails (opens, clicks)
  • Actions on the Site (button clicks, downloads)

4.4 Transaction data

  • Order information (product, date, amount)
  • Payment data (processed exclusively by our secure payment provider — we do not store any bank card data)

We do not collect any special category data within the meaning of Article 9 GDPR.

5. How we collect data

5.1 Direct collection

Some data is collected directly from you, when you complete a registration, order or contact form, or when you subscribe to our mailing list.

5.2 Automatic collection

Some data is collected automatically when you visit the Site, by means of cookies, web beacons (pixels), server logs or statistical analysis tools.

5.3 Indirect collection

In some cases, data may be passed to us by third parties, in particular by our payment providers or by advertising platforms.

6. Purposes of processing

6.1 Order fulfilment

Processing your order, sending the confirmation, and providing access to the digital resource purchased.

6.2 Marketing communications

Sending communications relating to our resources, news and offers. You can unsubscribe at any time via the unsubscribe link present in every email.

6.3 Personalisation of the experience

Adapting the content of the Site to your interests, personalising the results of a quiz or a simulator.

6.4 Analysis and improvement

Measuring the audience of the Site, analysing browsing behaviour, optimising usability and performance.

6.5 Targeted advertising

Delivering targeted advertising on third-party platforms (in particular Meta / Facebook / Instagram), subject to your prior consent.

6.6 Legal and accounting obligations

Retaining billing and transaction data in accordance with legal obligations in matters of accounting and taxation.

7. Lawful basis for processing

Each processing of personal data is based on one of the lawful bases set out in Article 6 GDPR: consent, performance of a contract, legitimate interests or legal obligation. Where we rely on consent (for example for advertising cookies or marketing emails), you may withdraw that consent at any time.

8. Retention periods

  • Prospect data (non-customers): 3 years from the last contact
  • Customer data: for the duration of the commercial relationship, then 3 years after the last purchase
  • Billing and transaction data: 6 years from the end of the relevant accounting year, in line with UK record-keeping requirements
  • Browsing data and cookies: 13 months maximum
  • Data relating to a dispute: retained for the applicable statutory limitation period

9. Sharing of data

No personal data is sold, rented or transferred to third parties without a lawful basis. Your data is only shared with the recipients strictly necessary for the provision of our services.

We may be required to disclose your personal data in response to a court order, a lawful request from a public authority, or any other legal or regulatory obligation.

10.1 Vercel Inc.

Function: Hosting of the Site.
Data processed: Browsing data, server logs.
Location: United States (transfers safeguarded — see section 13).

10.2 Resend

Function: Sending transactional and marketing emails, managing the contacts database.
Data processed: First name, email, email interaction data.
Location: United States (transfers safeguarded).

10.3 Meta (Facebook / Instagram)

Function: Advertising tracking pixel, creation of custom audiences.
Data processed: Anonymised or pseudonymised browsing data (via the Meta pixel).
Location: United States (transfers safeguarded).

10.4 Microsoft Clarity

Function: Audience analytics and session-behaviour analysis (heatmaps, session recordings) to improve the Site.
Data processed: Browsing data, interaction data.
Location: United States (transfers safeguarded).

10.5 Stripe / PayPal

Function: Secure online payment processing.
Data processed: Bank card data (processed directly by the providers, never stored by us).
Security: SSL/TLS encryption, PCI-DSS compliance.

11. Cookies and tracking technologies

11.1 Definition

A cookie is a small text file placed on the user's device when visiting a website.

11.2 Types of cookies used

Strictly necessary cookies: Essential to the operation of the Site. These cookies do not require your consent.

Analytics cookies: Used to measure the audience of the Site and optimise its operation.

Advertising cookies: Used to deliver targeted advertising (Meta pixel).

11.3 Consent

In accordance with the European Communities (Electronic Communications Networks and Services) (Privacy and Electronic Communications) Regulations 2011 (S.I. No. 336/2011) and the GDPR, the placing of analytics and advertising cookies is subject to your prior consent.

11.4 Managing cookies

11.5 Cookie lifespan

Cookies placed on your device have a maximum lifespan of 13 months from the date they are placed.

12.2 Organisational measures

Access to personal data is limited to those who strictly need it. Our processors are contractually bound to respect the confidentiality of the data.

12.3 Breach notification

In the event of a personal data breach likely to result in a risk to your rights and freedoms, we undertake to notify the competent supervisory authority (the Data Protection Commission, DPC) within 72 hours, in accordance with Article 33 GDPR.

13. International transfers

Some of your personal data may be processed and stored outside the European Economic Area, in particular by processors established in the United States.

Where personal data is transferred outside the European Economic Area, we ensure that appropriate safeguards are in place within the meaning of Chapter V GDPR: an adequacy decision of the European Commission (including the EU-U.S. Data Privacy Framework for certified recipients in the United States), or the Standard Contractual Clauses adopted by the European Commission, together with any additional measures required.

13.1 The controller is established outside the EEA

Eversales Consulting LLC is established in the United States. Because we offer goods and services to data subjects in the European Union, our processing of your data is subject to the GDPR under Article 3(2), and the rights described in this Policy apply to you in full. Requests may be sent to raphael@myestatekit.eu, and you retain the right to lodge a complaint with the Data Protection Commission in Ireland (see section 15.4).

In accordance with the GDPR and the Data Protection Act 2018, you have the following rights:

15.1 How to make a request

15.2 Identity verification

For security reasons, we may need to ask you to verify your identity before processing your request.

15.3 Response time

We undertake to respond to your request within one month of receiving it. This period may be extended by a further two months in cases of complexity.

15.4 Complaint to the DPC

If you consider that the processing of your personal data constitutes a breach of the GDPR, you have the right to lodge a complaint with the Data Protection Commission (DPC):

16. Protection of minors

The Site and the resources offered are intended for an adult audience. We do not knowingly collect personal data from children under the age of 16 (the digital age of consent in Ireland under section 31 of the Data Protection Act 2018).

If we learn that the personal data of a minor has been collected without the verifiable consent of their parent or guardian, we will take the necessary steps to delete that data as soon as possible.

We reserve the right to amend this Policy at any time. The date of the last update is indicated at the top of this page. In the event of a substantial change, we will endeavour to inform users by email or by a visible notice on the Site.
